Jugement du juriste sahraoui en appel, à El-Ayoune
Le juriste sahraoui, défenseur des droits humains et coprésident du CORELSO, Mr. Ennaâma ASFRAI, a comparu, aujourd’hui lundi 05 mai 2007, devant la cour d’appel d’El-Ayoune.
Mr. ASFARI a répondu aux accusations de la cour que son jugement vient dans le contexte la répression qui s’abat sur la population sahraouie et représente un épisode d’une série sans fin de procès iniques dont sont victimes les défenseurs sahraouis des droits humains. Il a également rappelé la cour qu’elle devait prendre en considération, lors de ce procès, l’hiérarchie des sources de législations, surtout les conventions relatives aux droits humains que le Maroc avait signé et ratifié, notamment : la Convention contre la torture et autres peines ou traitements cruels, inhumains ou dégradants, la Convention relative aux droits de l’enfant, la Convention relative à la protection des défenseurs des droits de l’homme.
Mr. ASFARI a aussi stressé que son jugement s’inscrit dans le contexte de la continuité des violations des droits humains au Sahara Occidental et la dénégation de tous les droits aux citoyens sahraouis. Il également rappelé les violation dont sont victimes récemment un grand nombre de citoyens sahraouis et aussi ce que subissent les étudiants sahraouis ces derniers jours à l’université IBNOU ZOHR d’Agadir (sur du Maroc).
Mr. ASFARI a aussi exprimé son soutien à tous les détenus politiques sahraouis à leur tête le secrétaire général de l’ASVDH, Mr. Brahim SABBAR, et son soutien à la lutte du peuple sahraoui pour son droit à l’autodétermination.
La cour a alors décidé de levé la séance et que la sentence sera prononcée le 21 mai prochain.Nous rappelons que deux avocats français, Maître France WEYL et Maître Aline CHANU, ainsi que le juge italien, Mr. Nichola QUATRANO, avaient assisté en qualité d’observateurs à ce procès. Et malgré la présence remarquable des forces sécuritaires marocaines qui encerclaient le tribunal, certains défenseurs des droits humains ont pu s’infiltrer à l’intérieur et assister au procès, parmi eux, Sidi Mohamed DADACH, président du Comité pour le Soutien de l’Autodétermination au Sahara Occidental

Judgement of the Sahrawi lawyer in appeal, in El-Ayoune
The Sahrawi lawyer, human rights defender and co-president of the CORELSO, Mr. Ennaâma ASFRAI, appeared today Monday May 5, 2007, before the Court of Appeal of El-Ayoune.
Mr. ASFARI answered the charges of the court that his judgement comes in the context of the repression which falls on the Sahrawi population and represents an episode of a series without end of iniquitous lawsuits to which, Sahrawi human rights defenders are victims.
He also pointed out that the court must take into account, during this lawsuit, the hierarchy of the sources of legislations, especially conventions on the human rights that Morocco had signed and ratified, in particular: convention against torture and other sorrows or cruel treatments, inhuman or degrading, the Convention on the rights of the child, the Convention on the protection of the human rights defenders.
Mr. ASFARI has also stressed that his judgement comes in the context of the continuity of the violations of the human rights in Western Sahara and the denial of all the rights to the Sahrawi citizens. He also pointed out the violation of which are victims recently a great number of Sahrawi citizens and also what the Sahrawi students undergo these last days at university IBNOU ZOHR in Agadir (south of Morocco).
Mr. ASFARI also expressed his support for all the Sahrawi political prisoners, at their head the secretary general of the ASVDH, Mr. Brahim SABBAR, and his support for the fight of Sahrawi people to self-determination.
The court then decided of survey the meeting and that the sentence will be pronounced next on May 21.
We point out that two French lawyers, Maître France WEYL and Main Aline CHANU, as well as the Italian, Mr. Judge Nichola QUATRANO, had attended as observers this lawsuit. And in spite of the remarkable presence of the Moroccan security forces which encircled the court, some human rights defenders could infiltrate inside and assist the lawsuit, among them, Sidi Mohamed DADACH, president of the Committee for the Support of Self-determination for Western Sahara.
