Report du jugement en appel de Mr. Said ELBAILLAL au 27 mars
La cour d’appel de Rabat (Maroc), a décidé, aujourd’hui jeudi 6 mars 2008, de reporter le procès, en appel, de Mr. Said ELBAILLAL au 27 mars 2007. Ce dernier avait été condamné par la cour de première instance de Rabat à huit mois de prison ferme pour incitation aux émeutes, attroupements armés et agression d’un fonctionnaire en service.
L’audience, à laquelle ont assisté les défenseurs sahraouis des droits de l’homme, Mr. Sidi Mohamed DADACH et Mr. Sid Ahmed LEMJEID, a été marquée par une tentative d’agression, contre Mr. Said ELBAILLAL, de la part de certains avocats. Mr. ELBAILLAL scandai, à son entrée dans la salle, des slogans en faveur du droit du peuple sahraoui à l’autodétermination, ce qui a été considéré par les agresseurs comme une atteinte à ‘la nation’.
Par ailleurs, la cour d’appel d’EL-Ayoune, a décidé, hier mercredi 5 mars 2008, de réduire à deux ans la peine des deux policier, condamnés par la cour de première instance à dix ans de prison ferme. Ces derniers ont été libéré après avoir purgé leur peine. Les organisations des droits de l’homme avaient exprimé leur crainte que la peine de ces deux accusés d’avoir tué le citoyen sahraoui Mr. Hamdi LEMBARKI, lors du jugement en appel. Les craintes de ces ONGs reposent sur le fait que le procès de ces deux officiers de la police a été mené pour éviter la pression de l’opinion publique. La réduction de cette peine, hier, confirme, donc, les soupçons de ces ONGs.

Report of the lawsuit of Mr. Said ELBAILLAL, in appeal, to 27 March
The Court of Appeal in Rabat (Morocco), decided today Thursday, March 6, 2008, to postpone the trial, on appeal, of Mr. Said ELBAILLAL to 27 March. The latter was sentenced by the Court of First Instance in Rabat to eight months of prison for inciting riots, armed gatherings and assault of a public officer on duty.
The trial which was attended by the Saharawi human rights defenders, Mr. Sidi Mohamed and Mr. DADACH Sid Ahmed LEMJEID, has been marked by an attempt of aggression against Mr. Said ELBAILLAL, on the part of some lawyers. Mr. ELBAILLAL was shouting slogans, as he enters the room, supporting the right of the Saharawi people to self-determination, which was considered by the attackers to be an insult to the nation.
Furthermore, the Court of Appeal of EL-Ayoune, decided yesterday Wednesday, March 5, 2008, to reduce to two years the sentencing of the two police officers, sentenced by the Court of First Instance to ten years in prison. They were released after serving their sentences. Human Rights Organizations had expressed its fear that the sentence of the two accused of killing the Saharawi citizen, Mr. LEMBARKI Hamdi, in the judgement on appeal. Fears of these NGOs are based on the fact that the trial of the two police officers was conducted to avoid the pressure of public opinion. The reduction of the sentences yesterday confirms, therefore, suspicions of these NGOs.
