Réduction des peines des détenus politiques sahraouis, à Agadir, et enlèvement de l’ex-détenu politique sahraoui, Mr. Abderrahman BOUGARFA
Cinq détenus politiques sahraouis, en prison civile d’Inezgane, sud du Maroc, ont comparu aujourd’hui, lundi 14 mai 2007, devant la cour d’appel d’Agadir. La cour adécidé de réduire leur peine à deux ans de prison ferme.
Les cinq détenus politiques sahraouis avaient été condamnés par la cour de première instance de la même ville à des peines allant d’un an à quatre ans.
Il s’agit de :
Mr. Mohamed TAMEK, arrêté le 15 avril à Assa, détenu à Inzegane, condamné 4 ans par la cour de première instance d’Agadir
Mr. Brahim KAJOUT, arrêté le 15 avril à Assa, détenu à Inzegane, condamné 3 ans par la cour de première instance d’Agadir
Mr. Driss MANSOURI, arrêté le 15 avril à Assa, détenu à Inzegane, condamné à 3 ans par la cour de première instance d’Agadir
Mr. Bachir NAJIAA, arrêté le 15 avril à Assa, détenu à Inezgane, condamné 4 ans par la cour de première instance d’Agadir.
Le jugement de ces détenus politiques sahraouis, a été assisté par des observateurs espagnols et aussi par le président de l’asvdh. Ces derniers ont remarque que ces procès sont lion d’être équitables et que les témoins ont affirmé n’avoir reconnu aucun de ces détenus ce qui doit, normalement, les acquitter.Par ailleurs, et à El-Ayoune, l’ex-détenu politique sahraoui, Mr. Abderrahmane BOUGARFA et son fils, ont été enlevés de leur maison tôt ce matin, vers 4 heures du matin par la police marocaine. La famille de Mr. BOUGARFA, dans son contact avec l’asvdh, dit n’avoir aucune connaissance de la raison pour laquelle ses deux membres ont été enlevés. La famille a également contacté les responsables de la police judicaire qui ont refusé leur répondre sur le sort des deux disparus. De même, l’asvdh a remarqué que les autorités marocaines ont font retour aux pratiques des années soixante dix et quatre vingt. L’asvdh a aussi été averti, en plus du cas de Mr. BOUGARFA et son fils, que des agents de police sont venus, à quatre heures du matin, à la maison de la famille sahraouie AHL ESSID, qui a refusé ouvrir la porte. Les agents de la police sont restés devant la porte de la maison pendant plusieurs heures avant de quitter. Ces deux cas marque un retour vers la disparition forcée dont sont victime plus de 500 citoyens sahraouis, dont le sort est toujours inconnu. C’est pourquoi l’asvdh lance un appel très pressant à toutes les ONGs des droits humains et à l’ONU pour agir en vitesse pour obliger l’Etat marocain à respecter les droits et les libertés au Sahara Occidental. Nous rappelons aussi que ces deux cas marquent la violation flagrante de la convention relative à la à la disparition forcée que le Maroc avait signé et ratifié

Reduction of the sentences against the Sahrawi the political prisoners, in Agadir, and the kidnapping of the Sahrawi ex-political prisoner, Mr. Abderrahman BOUGARFA
Five Sahrawi political prisoners, in the civil prison of Inezgane, south of Morocco, appeared today, Monday May 14, 2007, before the Court of Appeal of Agadir. The Court decided to reduce their sentences to two years of firm prison.
The five Sahrawi political prisoners had been condemned by the court of first authority of the same city to sentences going from one year to four years.
It is about: Mr. Mohamed TAMEK, arrestd on April 15 with Assa, prisoner in Inzegane, condemned to 4 years by the court of first authority of Agadir
Mr. Brahim KAJOUT, arrested on April 15 in Assa, prisoner in Inzegane, condemned to 3 years by the court of first authority of Agadir
Mr. Driss MANSOURI, arrested on April 15 in Assa, prisoner in Inzegane, condemned to 3 years by the court of first authority of Agadir
Mr. Bachir NAJIAA, arrested on April 15 in Assa, prisoner in Inezgane, condemned to 4 years by the court of first authority of Agadir.
The judgement of these Sahrawi political prisoners was assisted by Spanish observers and also by the president of the asvdh. The latter have noticed that these lawsuits are far from being equitable and that the witnesses affirmed not to have seen any of these prisoners what must, normally, discharge them.
In addition, and in El-Ayoune, the Sahrawi ex-political prisoner, Mr. Abderrahmane BOUGARFA and his son were kidnapped from their house early this morning, around 4 in the morning by Moroccan police. The family of Mr. BOUGARFA, in his contact with the asvdh, says not to know any of the reasons for which its two members were kidnapped. The family also contacted the persons in charge for the judicial police who refused to answer them on the fate of both disappeared. In the same way, the asvdh noticed that the Moroccan authorities have make return to the practices of the seventies and eighties. The asvdh was informed, in addition to the case of Mr. BOUGARFA and his son, that some policemen came, today at four o'clock in the morning, at the house of the Sahrawi family, AHL ESSID, which refused to open the door. The policemen remained in front of the door of the house during several hours before leaving. These two cases mark a return towards the forced disappearance of which were victims more than 500 Sahrawi citizens, whose fate is always unknown. This is why the asvdh launch a very pressing call in all NGOs of the human rights and to UNO to act as soon as possible to oblige the Moroccan State to respect the rights and freedoms in the Western Sahara. We also point out that these two cases mark the obvious violation of the convention related to forced disappearance that Morocco had signed and ratified.
