La cour de première instance d’El-Ayoune acquitte les membres de l’ASVDH
La cour de première instance d’El-Ayoune a acquitté, hier lundi 22 octobre 2007, les deux membres de l’ASVDH, Mr. Brahim SABBAR et Mr. Ahmed SBAI de même que les détenus politiques sahraouis, Mr. Elhafed TOUBALI, Mr. Ahmed Salem AHMEIDAT, Mr. Mohamed Lehbib ELGASMI et Mr. Abdessalam LOUMADI.
Nous rappelons que ces détenus politiques sahraouis avaient été chargé par la cour d’avoir offensé les magistrats. Cette nouvelle accusation, selon des sources très fiables, a été déterminée dans une circulaire du ministère de la justice marocaine pour contraindre les détenus politiques sahraouis à ne plus scander des slogans affichant des positions politiques relatifs au droit du peuple sahraoui à l’autodétermination. De même, et lors de la séance du lundi 08 octobre 2007, ces cinq détenus avaient été évacué de la salle d’audience une minute après leur entrée pour avoir scandé des slogans dénonçant leur jugement inique et inéquitable. Après leur évacuation, les cinq sahraouis ont été mis dans une voiture de la police où ils ont été violement tabassé et insultés avant de les remettre dans une autre voiture qui les a conduit à la prison sans qu’ils y droit à se défendre devant la cour. Les familles de ces cinq détenus avaient été conduites vers une salle d’audience à la cour d’appel alors que le procès se déroulait dans autre salle à la cour de premier degré. Cette nouvelle manœuvre policière n’a pas permis à ces familles d’assister au procès de leurs enfants.
Nous rappelons aussi que Mr. Brahim SABBAR avait été condamné dans un premier dossier à deux ans de prion ferme (en compagnie du détenu politique sahraoui Mr. Ahmed Mahmoud HADDI, qui a été condamné à trois ans de prison ferme, et son frère Mr. Mohamed Lamine HADDI, qui a été condamné à un avec sursis) comme il a été condamné à un an et demi de prison ferme en compagnie de Mr. Ahmed SBAI.
Dans le contexte des jugements des membres de l’ASVDH, dont trois sont toujours en prison (Mr. Brahim SABBAR, Mr. Ahmed SBAI et Mr. Mohamed TAHLIL), le procès de Mr. Sadyk BOULLAHI, membre du bureau exécutif a été mis délibération pour le 1er Novembre 2007. Cette décision a été prise par la cour de première instance d’El-Ayoune le 11 octobre dernier. Nous rappelons à cet égard que Mr. BOULLAHI a été chargé de constitution d’une association non autorisée. En outre, trois autres détenus politiques sahraouis, Mr. Khallihenna Cheik Ali DLIMI, Mr. Mohamed Ahmed BARKOUH et Mr. Hamid Ahmed BARKOUH, arrêtés à Smara juin dernier et incarcérés à la prison noire d’El-Ayoune, comparaîtrons, après demain, jeudi 25 octobre 2007, devant la cour de prier degré d’El-Ayoune, comme décidé lors de la séance du mercredi 19 septembre 2007

The Court of First Instance El-Ayoune pays members of the ASVDH
The Court of First Authority of El-Ayoune acquitted yesterday Monday, October 22, 2007, two members of the ASVDH, Mr. And Mr. Brahim SABBAR Ahmed SBAI as well as other Saharawi political prisoners, Mr. Elhafed TOUBALI, Mr. Ahmed Salem AHMEIDAT, Mr. Mohamed Lehbib ELGASMI and Mr. Abdessalam LOUMADI.
We recall that the Saharawi political detainees had been charged by the court for having offended the magistrates. The new indictment, according to very reliable sources, was determined in a circular by the Ministry of Justice to compel the Sahrawi political detainees not to stress slogans posting of the political positions more relating to the right of the Sahrawi people’s to self-determination. Similarly, and during the lawsuit of Monday, October 8, 2007, these five detainees were evacuated from the courtroom one minute after entering the courtroom for having shouted slogans denouncing their iniquitous and inequitable sentences. After their evacuation, the five Sahrawi prisoners were put in a police car where they were violently bitten and insulted before giving them in another car which lead them to the prison which prevent them from there right to defend themselves before the court. The trial was then put in deliberation and the judgement will be read on October 22. The families of these five prisoners were led towards a courtroom at the Court of Appeal whereas the lawsuit proceeded in another room in the court of first degree. This new police operation did not make it possible for these families to attend the lawsuit of their children.
We also recall that Mr. Brahim SABBAR had been condemned to two years of firm prison (in company of the Sahrawi political prisoner Mr. Ahmed Mahmoud HADDI, who was condemned to three years of firm prison, and his brother Mr. Mohamed Lamine HADDI, who was condemned to one year with deferment) as he was condemned to one year and half of firm prison in company of Mr. Ahmed SBAI.
In the context of the judgments againts members of the ASVDH, three of which are still in prison (Mr. Brahim SABBAR, Mr. Ahmed and Mr. Mohamed SBAI TAHLIL), the lawsuit of Mr. BOULLAHI Sadyk, member of the executive bureau of the ASVDH has been set for deliberation on November 2007. This decision was taken by the Court of First Instance of El-Ayoune in Oct. 11. We recall in this regard that Mr. BOULLAHI was charged for constitution of an unauthorized association.
In addition, three other Saharawi political prisoners, Mr. Sheikh Ali Khallihenna DLIMI, Mr. Mohamed Ahmed and Mr. BARKOUH BARKOUH Hamid Ahmed, arrested in Smara last June and incarcerated in the prison black El-Ayoune, will appear the day after tomorrow, Thursday, October 25, 2007, before the court of first authority of El-Ayoune, as was decided during audience of Wednesday, September 19, 2007.
