Condamnation de Mr. ASFARI a deux mois de prison ferme
Le défenseur sahraoui des droits de l’homme, Mr. Ennaâma ASFARI, Coprésident du CORELSO, a comparu, hier lundi 28 avril 2008, devant la cour de première instance de Marrakech, pour des charges suivantes :
- Conduire en en état d’ivresse
- Possession d’une arme blanche (un couteau)
- Avoir frappé à l’œil une automobiliste suite à un accrochage de la voiture.
La défense de Mr. ASFARI a mis l’accent sur les violations du Code pénal marocain qui garantit au détenu le droit de prévenir immédiatement un membre de sa famille (ce qui n’a pas été fait dans le cas de Mr. ASFARI) et la protection de l’intégrité physique des détenus (Mr. ASFARI a été tabassé avant de la mettre dans la voiture des policiers et a été torturé dans un lieu inconnu et on ne lui a pas permis de voir un médecin). AL défense a également souligné les contradictions entre le témoin et la plaignante et mis l’accent sur l’absence de preuve (la plaignante a nié avoir vu Mr. ASFARI avec un couteau, aucune analyse médicale n’a été effectué pour prouver l’état d’ivresse). Le défense a alors demandé au juge de se prononcer de façon juste et sérieuse et de garantir une justice équitable à l’accusé.
Mr. ASFARI, prenant la parole, a précisé l’aspect politique de son jugement et a réfuté les accusations de la cour et a maintenu qu’il a été détenu sur la base de ses positions politiques en relation avec le conflit du Sahara Occidental.
La cour a alors prononcé une peine de deux mois de prison ferme contre Mr. Ennaâma ASFARI et une amende de trois milles de dirhams (3.000.00). La défense de Mr. ASFARI a décidé de faire appel.
Mr. ASFARI a été soutenu par les avocats, Me. Mohamed SABBARI et Me. Mustapha RACHIDI, et deux observateurs français, France WEYL et Aline CHANU, quatre observateurs espagnols et deux observateurs d'associations des Droits de l'Homme marocains en plus d’activistes sahraouis, comme l'ancien prisonnier sahraoui Sidi Mohamed DADACH président du CODAPSO, Mohamed MAYARA, membre du bureau exécutif de l’ASVDH, et Sid Ahmed LEJEYID, président du CSPRON.
Nous rappelons que Mr. ASFARI a été arrêté le 13 avril 2008 à Marrakech. Après divers lieux de détentions où il a subi des mauvais traitements, il a été présenté au procureur le 15 avril et est détenu depuis le 17 avril 2008 à la prison Boulemharez de Marrakech.

Mr. ASFARI sentenced to two months in prison
The Saharawi human rights defender, Mr. Ennaâma ASFARI, co-president of the CORELSO, appeared yesterday Monday, April 28, 2008, before the court of first instance in Marrakech, for the following charges:
- Driving in a state of drunkenness
- Possession of a white weapon (a knife)
- Having beaten a motorist on eye following a car clash.
The defence of Mr. ASFARI focused on violations of the Moroccan Penal Code which guarantees the detainee's right to prevent immediately a family member (which has not been done in the case of Mr. ASFARI) and protection of the physical integrity of the detainees (Mr. ASFARI was beaten before putting him in the police car and was tortured in an unknown location and he was not allowed to see a doctor). The defence also pointed out the contradictions between the witness and the complainant and emphasized the absence of evidence (the complainant denied seeing Mr. ASFARI with a knife, no medical analysis has been conducted to prove the drunk). The defence then asked the judge to rule fairly and seriously and to ensure a fair trial to the accused.
Mr. ASFARI, speaking, emphasised the political aspect of his judgement and refuted the accusations of the court and maintained he was detained on the basis of his political positions in relation to the conflict of Western Sahara.
The court then pronounced a sentence of two months' imprisonment against Mr. Ennaâma ASFARI and a fine of three thousands dirham (3.000.00). The defence of Mr. ASFARI decided to appeal.
Mr. ASFARI was supported by lawyers, Me Mohamed SABBARI and Me RACHIDI Mustapha, and two French observers, France WEYL and Aline CHANU, four observers from Spain and two observers from Moroccan Human Rights associations in addition to Sahrawi activists, such as the former Sahrawi prisoner Sidi Mohamed DADACH president of CODAPSO, Mohamed MAYARA, member of the executive office of the ASVDH, and Sid Ahmed LEJEYID, president of CSPRON.
We recall that Mr. ASFARI was arrested on April 13, 2008 in Marrakech. After various places of detention where he suffered mistreatment, he was presented to the prosecutor on April 15 and has been detained since April 17, 2008 at the prison Boulemharez in Marrakech.
